Do independent truck owner operators require Workers' Compensation Insurance?

In California, independent owner operators generally do not require Workers’ Compensation Insurance for themselves, with some notable exceptions. The key distinction lies in whether they are truly classified as “independent contractors” or if they should legally be considered “employees.” 

If a trucking operation treats an owner operator as a true independent contractor, they are typically self-employed and responsible for their own insurance needs, including occupational accident coverage, which serves a similar purpose to workers’ comp for self-employed individuals.

What are included in Workers' Compensation for truckers?

Workers’ Compensation Insurance for truckers is designed to provide a financial safety net for both employees (mainly truck drivers) and the trucking company in the event of workplace injuries or illnesses. Usually, truckers workers compensation insurance covers lost wages, medical expenses, rehab expenses, and death benefits in case of death of truck drivers. 

Lost wages, generally are calculated as two-thirds (66.67%) of the injured trucker’s average weekly gross wages earned prior to the injury. This percentage can vary slightly by state, but two-thirds is a common standard. This calculation typically includes not only base pay or mileage rates but also other forms of regular compensation such as bonuses and commissions.

Do all states mandate Workers' Compensation Insurance for truckers workers?

No, all states do not mandate Workers’ Compensation Insurance for all trucking workers. Texas is the only state where workers’ compensation insurance is generally not mandated for most private employers. Besides Texas, all other states require that trucking companies carry workers compensation insurance. However, every other state has its own unique laws, requirements, and penalties for workers’ comp insurance.
